Age Discrimination Attorneys

California workers are protected by both federal and state laws from age discrimination. These laws protect job applicants and employees who are 40 years of age or older. It is illegal for an employer to demote, deny employment, or terminate someone based on their age. It is also illegal for an employer to deny any employee privileges or benefits, such as on-the-job-training, promotion, hiring, or compensation, because of their age.

Age Discrimination Under Federal Law | ADEA

Under the Federal Age Discrimination in Employment Act (ADEA), employers with at least 20 employees are prohibited from discriminating against workers aged 40 or older. It specifically makes it unlawful for an employer to discharge any individual or otherwise to "discriminate against any individual in respect to his or her compensation, terms, conditions or privileges of employment".

Age Discrimination California Law | FEHA

California law also prohibits age discrimination. The Fair Employment and Housing Act (FEHA) protects workers aged 40 or older from discrimination in the workplace, or in hiring practices. While the law is similar to the ADEA, it has even wider coverage, applying even to smaller employers, which the state defines as "any employer with at least five employees".

Examples of Age Discrimination

Age discrimination can take many different forms. Sometimes it is obvious, but more often than not, it is subtle. The following are just some of the scenarios where age discrimination occurs:

The company says that they are looking for someone with more energy, more vibrant, or a better culture fit

Older workers experiencing sudden drops in performance reviews after years of positive reviews

Using Reduction-In-Force as a way to rid the company of older workers

If you have experienced any situations similar to these, it is important to contact and experienced age discrimination lawyers. At Buchsbaum & Haag, we will sit down with you to discuss all aspects of your case, review any documents you may have and go over the facts with you in detail.
